Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the InfluQ website at influq.com, our applications, and related services (collectively, the “Service”), operated by InfluQ (“InfluQ”, “we”, “us”, or “our”). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Subscriptions, Free Trial & Billing

• Free trial. We may offer a time-limited free trial. Unless you upgrade, access ends when the trial expires. We reserve the right to modify or withdraw trials at any time.
• Plans. Paid plans are billed in advance on a monthly or annual basis at the prices shown at checkout (in INR unless stated otherwise), plus applicable taxes.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period until cancelled. By subscribing you authorize us and our payment processor to charge your payment method on each renewal.
• Cancellation. You may cancel at any time; access continues until the end of the current period. See our Refund & Cancellation Policy for details.
• Price changes. We may change prices with reasonable prior notice; changes apply to the next billing cycle.

4. Payments

Payments are processed by third-party payment providers (including Razorpay). We do not store your full card details. You agree to the payment provider's terms in addition to these Terms, and you represent that you are authorized to use the payment method provided.

5. AI-Generated Content & No Guarantee of Results

The Service uses artificial intelligence to generate strategies, scripts, topic ideas, analytics interpretations, coaching, and other outputs. These outputs are generated automatically and may be inaccurate, incomplete, or unsuitable for your situation. You are solely responsible for reviewing, editing, and deciding whether to use any output.

• We make no guarantee of any specific results, growth, views, subscribers, revenue, or outcomes.
• Outputs do not constitute professional, legal, financial, tax, or investment advice.
• You are responsible for ensuring your content complies with the policies of any platform on which you publish (including YouTube) and with applicable law.

6. Acceptable Use

You agree not to:

• Use the Service for anything unlawful, infringing, deceptive, or harmful;
• Reverse engineer, scrape, resell, or attempt to gain unauthorized access to the Service;
• Upload malware or interfere with the Service's operation or security;
• Generate content that is illegal, hateful, harassing, or violates the rights of others;
• Misrepresent your identity or violate any third-party platform's terms.

7. Third-Party Services

The Service integrates with third parties, including Google/YouTube, AI providers (such as Google Gemini and OpenAI), Supabase, Vercel, and Razorpay. Your use of those integrations is also subject to their terms and privacy policies. In particular, by connecting your YouTube channel you agree to be bound by the YouTube Terms of Service and acknowledge the Google Privacy Policy. We are not responsible for third-party services.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by InfluQ and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal use during your subscription.

9. Your Content

You retain ownership of the information and content you submit (“Your Content”), including onboarding answers, reflections, and strategy inputs. You grant us a license to host, process, and use Your Content solely to operate and improve the Service and to generate outputs for you. You are responsible for having the rights to submit Your Content.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or if required by law. Upon termination, your right to use the Service ends; certain provisions (including Sections 5, 8, 11–14) survive.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, InfluQ and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless InfluQ from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the Service or email. Continued use after changes take effect constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. The courts located in India will have exclusive jurisdiction over any dispute, subject to applicable law.
